James McCain had consider able business to attend to at the late Circuit court for Polk county. He was engaged by the prosecution in the case of the State v. Hutchins, indicted for an assault to commit rape, and thecause against J. C. Fletcher, indicted for seduction. Hutchina re ceived four years in the pen., and Fletcher was to be sentenced Satur day. Of this last action the ltemizer says: “The charge was that of se duction under promise of marriage preferred by Miss Mary Byerley, daughter of Ab. Byerley, of this coun ty. The defense subborn ly contested every word of evidence and made an eloquent plea to the jury, but that body after two hours deliberation re turned a verdict of guilty as charged in the indictment.” Besides those Mr. McCain was retained to prosecute in the case of the State v. Armstrong, indictment for atson, and in a civi cause entitled Lynch v. Blaine. The sermon preached by Archbish op Gross at the Catholic church in this city Sunday morning would con vince even a skeptic that there is a hell. His sermons were powerful in argument and eloquent in appeals to the intellect of man. A great deal of talent is lost to the world for want of a little courage, and the speaker forci bly impressed upon his hearers the fact that the truth was not preached at all times because it did not suit the taste of the audience to listen to it, and the poor preacher was afraid to do his whole duty for fear of dismissal. The same rule applies to the editorial fraternity in thousands of cases.
